No Paragard IUD settlement exists as of October 19, 2026, so there are no settlement amounts to report. The first jury trial ended in a defense verdict for Teva on February 3, 2026, 4,224 cases were pending in the federal litigation on October 1, 2026, and the next bellwether trial is set for April 12, 2027.
Websites that print Paragard payout ranges, such as "$10,000 to $400,000," are estimating: no court-approved or company-reported figure supports them. This page covers what has actually happened in the litigation and what it means for a claim.

Is there a Paragard settlement amount?
No. As of October 19, 2026, neither Teva nor Cooper has announced a settlement, and Teva's most recent quarterly report discloses no settlement program for Paragard. Payout tiers and per-person ranges that circulate online have no source. If the litigation ever settles, the amounts would come from a negotiated program with its own rules, and they cannot be predicted from one trial.
What has happened in the Paragard litigation?
- December 2025. The court granted in part and denied in part Teva's motion arguing that federal law blocks the claims (preemption).
- January 20 to February 3, 2026. The first bellwether trial ended in a defense verdict for Teva.

|---|---|
| January 5, 2026 | 3,800 |
| March 2, 2026 | 3,926 |
| August 3, 2026 | 4,156 |
| October 1, 2026 | 4,224 |
The counts come from the Judicial Panel on Multidistrict Litigation's pending-case reports. In all, 4,552 cases have been filed in the MDL.
What does the defense verdict mean for settlement amounts?
A bellwether is a test case: one plaintiff's claim chosen to show how a jury sees the evidence. The February verdict decides only that case, and it does not end the other 4,000-plus cases. In mass torts, a plaintiff verdict usually raises the pressure to settle and a defense verdict does not. The court has scheduled more bellwether trials, so until a settlement is announced, any payout figure is a guess.
What can a Paragard injury claim include?
A claim can seek medical bills for the removal surgery and follow-up care, lost wages, pain and suffering, and the effects of any lasting damage, including on fertility. Its value depends on the individual's injuries and records, not on a published grid. Surgical and removal notes showing that the device broke are the most important evidence.
How long do I have to file a Paragard lawsuit?
The deadline is set by state law and generally counts from the injury, though some states delay the start until you discover the harm. In Texas, a personal injury claim generally must be filed within two years (Civil Practice and Remedies Code section 16.003), and other states differ. On August 26, 2026 the defendants asked the court to dismiss cases they say were filed too late, so timing matters. There is no court-set registration deadline or claim form.
Paragard, Mirena and Johnson & Johnson: which lawsuit is which?
- Paragard is a non-hormonal copper IUD, made by Teva until 2017 and by CooperSurgical since.
- Mirena is Bayer's hormonal IUD. The federal litigation over Mirena and brain-pressure (pseudotumor cerebri) ended with summary judgment for Bayer, which the Second Circuit affirmed in December 2020, according to legal-news reports.
- Johnson & Johnson does not make Paragard. Its talc litigation (MDL 2738) is separate, with 69,340 cases pending on October 1, 2026.
